The C-V2X simulator is a development by Fraunhofer-Gesellschaft zur Förderung der angewandten Forschung e.V, Fraunhofer-Institut für Integrierte Schaltungen IIS („Fraunhofer IIS“). This software-based simulation platform is not intended for consumers and runs in any web browser and allows registered users to define the simulation parameters for a vehicle-to-network (V2N) use case and perform simulation runs in different geographic scenarios in a city, on the country road & highway via a user interface. The results appear on a dashboard that visualizes key performance indicators (KPIs), such as reliability, latency, jitter and packet loss. After completing the simulations, registered users can compare the results of the simulation runs (section "Compare Simulations"), generate report files (button "Generate Report") and download them as .pdf files. The KPI results for reliability, throughput, latency, jitter and packet loss (.csv files) and geographic heatmaps (.kmz files) can also be downloaded (button “Download”). Additionally, one can view the corner cases in the scenario on the geographic heatmap (button “View KPI Heatmap”). The simulation results remain stored (section “Completed Simulations”) until the user deletes them.
This simulation environment is based on years of experience by Fraunhofer Engineers and our academic partners.
You may use this software and/or program exclusively to get an impression of Fraunhofer’s simulation capabilities in a selected scenario and for the generation of test results based on given parameters.
Fraunhofer IIS therefore grants you a limited, non-exclusive, non-transferable, non-sublicensable, royalty-free evaluation license to use the simulator under the given conditions and a further limited, non-exclusive, non-transferable, non-sublicensable, royalty-free license to use the DOCUMENTATION and its contained information for internal use only. Any other and/or further use is not permitted. Any commercial use shall be governed by a licence Agreement to be agreed on with Fraunhofer IIS.
Registration on this simulation platform is not allowed for consumers. With your registration on this simulation platform, you declare that you are no consumer in the sense of art. 13 of the German Civil Code (BGB).
THE DOCUMENTATION OR THE USE OF THE C-V2X-SIMULATOR DOESN’T GRANT ANY PATENT LICENCE. PATENT LICENSES FOR NECESSARY PATENT CLAIMS MAY BE OBTAINED ONLY DIRECTLY FROM THE RESPECTIVE PATENT OWNERS.
These Terms of Use do not include a license to any third-party programs or platforms. If the Simulator and its contained Software is designed to run on a third-party program or platform (e.g. Android, iOS etc), you understand that it may be required to execute a separate license agreement with the right holder of such third-party program or platform (e.g. Google Inc., Apple Inc. etc) in order to obtain all rights necessary. You will contact such right holder and negotiate in good faith the relevant agreement, if any.
The Open Source software components of the simulator are not subject matter of these Terms of Use. Each Open Source software component is copyrighted by a third party/third parties, namely the copyright holder/s indicated in the copyright notices in the corresponding source files or other materials accompanying the respective Open Source software as listed under https://simappweb.iis.fraunhofer.de/simappweb_oss_licenses.zip file. Each Open Source software component is licensable under its own applicable license conditions. Recipient has to review the licenses under which the respective Open Source software is licensed in order to understand the rights and obligations applicable to it. In no event will anything in this Agreement be construed as granting Recipient any (sub)license to the Open Source software. Subject to the Disclaimer below Fraunhofer IIS assumes no warranty and is not liable that Open Source software components are free from any error or claim or its fitness for a particular purpose even though they are included in the Software. Recipient warrants and represents and covenants not to use any Software or any part thereof in a manner that would subject the Software or any part thereof to be licensable under any Open Source Software license and/or, if applicable, to contravene the terms of any Open Source Software license.
This simulator, its contained software and/or program is protected by copyright law and international treaties. Any reproduction or distribution of this simulator, the contained software and/or program, or any portion of it, other than granted by these terms of use may result in severe civil and criminal penalties, and will be prosecuted to the maximum extent possible under law.
THE INFORMATION IN THE DOCUMENTATION IS PROVIDED 'AS IS' AND, TO THE EXTENT PERMITTED BY LAW, WITHOUT ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR THAT THE IMPLEMENTATION OF THE CONTENTS OF THIS DOCUMENTATION WILL NOT INFRINGE ANY THIRD-PARTY PATENTS, COPYRIGHTS OR OTHER RIGHTS.
FRAUNHOFER IIS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY USE OF THE DOCUMENT OR THE PERFORMANCE OR IMPLEMENTATION OF THE CONTENT THEREOF. ANY USE OF THE CONTENT OF THE DOCUMENT IS DONE AT YOUR OWN RISK.
UNDER NO CIRCUMSTANCES DOES FRAUNHOFER ASSUME ANY LIABILITY OR GUARANTEE FOR THIRD-PARTY SOFTWARE, IN PARTICULAR OPEN SOURCE SOFTWARE COMPONENTS.
Unless Fraunhofer IIS has given its prior written consent (e.g. in form of an email), you will not, directly or indirectly, disclose to any third party (including, without limitation, through any press release, advertising, customer list, web page, blog or other promotional or marketing material of any kind) the content of the DOCUMENTATION nor identify Fraunhofer IIS as licensor, supplier or partner or otherwise publicly use any Fraunhofer name or trademark.
You declare that you are entitled to provide Fraunhofer IIS with your contact details: Your full name, company and email address; you also declare that Fraunhofer IIS may use the data to provide you with access to the C-V2X simulator and to communicate with you with regard to services concerning this C-V2X simulator project. The data processing is carried out on your request and your contact data will be used for your registration and authentication as a user of the Fraunhofer C-V2X simulator according to art. 6 I 1 b GDPR to enable you to run and retrieve personalized simulations. Fraunhofer IIS is also storing your contact data for a possible professional communication with regard to services concerning this specific C-V2X simulator project. Additional personal data is not required for the use of the simulator but can be entered freely via the registration form if desired. If given, it will be used to better get to know the clients interested in the C-V2X simulator and its processing is based on our legitimate interest according to art. 6 I 1 f GDPR. Fraunhofer declares that such personal data obtained through this Agreement will be used solely within fulfillment of this Agreement and for Fraunhofer’s own organizational purposes in accordance with the relevant Data Protection Laws. All personal data obtained for the purpose will be deleted with discontinuation of the purpose, except you have given your explicit consent that Fraunhofer IIS may store certain data longer or that Fraunhofer IIS is bound by statutory retention obligations to store your data longer. In this case your data will not be used for any other purposes. Please see Fraunhofer IIS’ data protection information for further details about Fraunhofer IIS’ treatment of your personal data.
These Terms of Use shall be governed by the laws of the Federal Republic of Germany without giving effect to its conflicts of law provisions.
Notwithstanding any other provision of this Agreement, your breach of the provisions of these Terms of Use and/or the use of the Simulator and its incorporated Software and/or the DOCUMENTATION for any purpose other than as provided in this Agreement will cause Fraunhofer IIS irreparable damage for which recovery of money damages would be inadequate, and that Fraunhofer IIS will therefore be entitled to seek timely injunctive relief to protect Fraunhofer IIS’ rights under this Agreement in addition to any and all remedies available at law.
